Shine Early Learning Professional Development Trainings and Workshops – Terms and Conditions
Please read these terms and conditions of use carefully before purchasing any products or services related to all Shine Early Learning, Inc. professional development workshops and trainings, including but not limited to Leadership Workshop Series (“LWS Services”), Group Coaching (“Group Coaching”), and Economic Well Being Small Groups (“EWSG”). These workshops and trainings may collectively be referred to as “SEL Workshops” and individually referred to as “SEL Workshop”. The SEL Workshops are hosted and owned by Shine Early Learning, Inc.
These terms and conditions (these “Terms”) govern your purchase and use of all SEL Workshops. By submitting an order form, checking any acceptance box, or otherwise confirming a purchase, you acknowledge and agree to be fully bound by these Terms, which are incorporated by reference into your order form.
You may not purchase or access any SEL Workshop unless you meet both of the following requirements:
- You agree to these Terms in their entirety; and
- You are at least 18 years of age.
1. Applicability of Terms and Conditions.
These Terms shall apply to your purchase of any and all SEL Workshops. These Terms are subject to change at any time without prior written notice by Acelero, Inc. (“Company,” “we,” “us,” or “our”). The most recent version of these Terms will be posted for your review at any time at shineearly.com/PDprograms/terms. Your continued use of the SEL Workshop(s) after any posting of updated Terms shall constitute your acceptance of such changes.
2. Order Form Controls.
In the event of any conflict or inconsistency between the terms of your applicable order form and these Terms, the terms of the order form shall govern with respect to the specific transaction detailed therein.
3. Modifications to Services.
We reserve the right to modify the SEL Workshops, including course content, trainers, formats, or delivery platforms, at any time, provided that such changes do not materially reduce the overall value of the offering.
4. Payment Terms.
All applicable prices are outlined in the order form provided to you. Shine Early Learning, Inc. reserves the right to modify prices at any time, at its sole discretion, until an order form for the purchase of a SEL Workshop has been signed by the purchaser. Promotions, if any, shall be governed by separate terms. You are responsible for all prices stated at the time of your transaction and any applicable taxes. Payments must be made via approved credit/debit card, check, or wire transfer. In the event a check is returned for insufficient funds or is otherwise dishonored, you will be responsible for a returned check fee of $35.00 or the maximum amount allowed by law. Additionally, you agree to promptly provide an alternative form of payment upon notification of the returned check.
5. Refunds.
- Full Refund: 100% refund if requested via email to the relevant address for your program payments@shineearly.com within 72 hours of purchase, and the training or workshop has not been accessed, downloaded, or attended.
- Partial Refund: 50% refund if requested via email to payments@shineearly.com more than 72 hours after purchase but at least six (6) weeks before the scheduled training, and the training has not been accessed.
- No refunds will be issued if the training has been accessed, downloaded, or attended in whole or in part, or if the request is made fewer than six (6) weeks before the training.
- All refund requests must be submitted to payments@shineearly.com and include the purchaser’s name, confirmation number, and date of purchase. Approved refunds will be processed to the original method of payment within a reasonable time.
6. Live Online or In-Person Cancellation/Postponement.
If a scheduled SEL workshop is live online or in-person training or event is canceled or postponed, we will notify registrants via email. If rescheduled, you may either attend the new date or request to apply your full payment as credit toward another training. If not rescheduled, you will receive a full refund.
7. Restrictions on Use of Course Materials.
All materials provided are the intellectual property of Shine, Inc. or its licensors. You may download one copy for personal, non-commercial use only, and may not reproduce, distribute, or share content without express written permission. Use of automated tools or sharing on networks is strictly prohibited.
8. Content and Intellectual Property.
All content is protected by copyright, trademark, and other intellectual property laws. You receive no ownership rights and may not alter or redistribute content. All rights not expressly granted are reserved by Acelero, Inc
9. Copyright Complaints.
If you believe your intellectual property rights have been infringed upon, please contact copyright@shineearly.com.
10. Privacy.
Your submission of personal information is governed by our Privacy Policy, available at shineearly.com/PDprograms/privacy
11. Representations, Warranties & Disclaimers; Limitations on Liability.
- (a) Your Representations: You represent that your purchase and use are lawful and personal.
- (b) Disclaimer: SEL Workshops are provided “AS IS” without warranties. We do not guarantee accuracy or results.
- (c) Liability Cap: Our liability shall not exceed the purchase price paid for the SEL Workshop at issue. We are not liable for indirect or consequential damages.
- (d) Indemnification: You agree to indemnify and hold us harmless from any claims related to your use or violation of these Terms.
12. Third-Party Beneficiaries.
These Terms do not confer rights on any third parties.
13. Force Majeure.
We are not liable for failure to perform due to events beyond our control (e.g., natural disasters, labor disputes, government orders).
14. Assignment.
You may not assign your rights without our prior written consent. We may assign our rights at our discretion.
15. Partial Invalidity
If any part of these Terms is found unenforceable, the remainder shall remain in full force.
16. Governing Law and Arbitration.
- (a) Governing Law: These Terms shall be governed by the laws of the State of New York.
- (b) Arbitration: All disputes shall be resolved by binding arbitration in New York County, NY, under the AAA Commercial Rules. You waive any right to jury trials or class actions.
17. No Waivers.
Failure to enforce any right does not constitute a waiver of future enforcement.
18. Notices.
We may contact you via email or mail. You are responsible for keeping your contact information current.

20. Entire Agreement.
These Terms, together with your order form and any related promotional terms, constitute the entire agreement between you and us regarding the SEL Workshops.
